Edge Cloud Subscription Definitions and Terms
All capitalized terms not defined herein have the meanings given to them in the governing terms agreed between Qualtrics and Customer. Qualtrics may modify these definitions at any time by posting a revised version on this website (https://www.qualtrics.com/edge-terms/) or otherwise providing notice to Customer. By continuing to use the Cloud Service after the effective date of any modifications to these product definitions, Customer agrees to be bound by the modified terms. Only the definitions and terms related to Customer’s specific purchase will apply to Customer.This Cloud Service provides Customer access to a dataset of potential respondents from whom Customer can collect Human Panel Responses or Synthetic Panel Responses up to the number of Interactions purchased under its Order Form.
Interaction types consumed under this SKU: Human Panel Responses and Synthetic Panel Responses (as defined below):
- Human Panel Response: A Human Panel Response is recorded and counted for completed and partially completed responses to any survey sent out by a User to a potential respondent, subject to the following: (i) Customers will be provided with the functionality necessary to determine whether only fully completed responses are recorded or whether partially completed responses are also recorded as a Human Panel Response; (ii) if a Customer determines that partial responses will be recorded, those partial responses will count as full responses for the purposes of this Usage Metric; (iii) any response not recorded in accordance with (i) and (ii) will be deleted instead; and (iv) once a response has been recorded, it can be deleted but will still count against the total number of Human Panel Responses a Customer has purchased.
- Synthetic Panel Response: A Synthetic Panel Response is recorded and counted for any response generated by algorithmic means subject to the following: (i) Customers will be provided with the functionality to identify a Synthetic Panel Response; and (ii) once a response has been recorded, it can be deleted but will still count against the total number of Synthetic Panel Responses a Customer has purchased.
- Access to a dataset does not constitute a transfer of ownership rights, title, or interest in the dataset made available to Customer. Customer shall have no intellectual property rights in such dataset.
- The data made available to Customer is provided on an “as-is” basis. Qualtrics (a) makes no warranties as to the completeness or accuracy of such data, whether express, implied, statutory, or otherwise, and (b) shall have no liability to Customer for such data.
- Portions of the data, features, and functionality made available to Customer are enabled through interactions with and links to third-party sources. If at any time, a third-party source stops making some or all of its features and functionality available to Qualtrics or available on terms acceptable to Qualtrics, then Qualtrics may stop providing access to such features or functionality without prior notice to Customer. Such a modification to the features or functionality shall not be considered a material degradation of the Cloud Service in accordance with Section 3.4 of the Qualtrics General Terms and Conditions or a comparable section of the Agreement or otherwise provide Customer with any termination right.
- Customer shall not sublicense, resell, or otherwise make available to any third parties, any data made available to Customer as a part of Edge.
